General Terms and Conditions
1. Scope of Application
These General Terms and Conditions apply to all orders placed from Switzerland or the Principality of Liechtenstein via the online shop www.houseart.ch, operated by Swiss Sorelle Trade Sàrl, Rue de la Corraterie 24, 1204 Geneva, Switzerland.
2. Offer and Conclusion of Contract
2.1 The presentation of products on www.houseart.ch does not constitute a binding offer but an invitation to place an order.
2.2 By clicking the “[order]” button, the customer submits a binding order for the products listed on the order page.
2.3 Immediately after receipt of the order, it is confirmed by e-mail. The sales contract comes into effect only when the seller confirms shipment of the goods by e-mail (order or shipping confirmation) or, at the latest, upon delivery of the goods.
2.4 In the case of advance payment, the purchase contract comes into effect upon confirmation of receipt of payment by the seller.
3. Right of Withdrawal
3.1 The consumer has the right to withdraw from the contract by returning the ordered products to the sender within 14 days of receipt of the goods. No justification for the return is required.
The withdrawal must be sent to:

3.2 The exercise of the right of return by the customer results in a settlement relationship, under which the services received under the sales contract must be returned by each party. The return shipping costs are borne by the customer.
3.3 The purchase price is refunded to the customer immediately upon receipt of the returned goods.
3.4 Swiss Sorelle Trade Sàrl, www.houseart.ch, reserves the right to deduct from the refundable purchase price or to charge compensation for any damage, improper use, or—where agreed—shipping costs. No deduction will be made if the loss of value was caused solely by handling necessary to establish the nature, condition, and functioning of the goods.
Swiss Sorelle Trade Sàrl, www.houseart.ch, may refuse reimbursement until the returned goods have been received or until the customer has provided proof of return shipment, whichever occurs first.
3.5 The right of return is excluded for sale or discounted products.
4. Prices and Shipping Costs
4.1 The prices indicated on the product pages include the statutory value-added tax (VAT) and all other price components. Prices are stated in Swiss francs (CHF).
4.2 In addition to the indicated prices, shipping costs may be charged depending on the delivery address, quantity, and type of goods. The exact amount of shipping costs is displayed to the customer during the ordering process. No additional charges apply for deliveries within Switzerland.
5. Delivery Conditions
5.1 Deliveries are made exclusively within Switzerland and the Principality of Liechtenstein.
5.2 Unless otherwise stated in the offer, the standard delivery time is 3 to 5 days.
5.3 If not all ordered products are available, Swiss Sorelle Trade Sàrl, www.houseart.ch, may make a partial delivery. No additional costs will be charged to the customer for partial deliveries.
5.4 If delivery fails due to the customer’s fault after three attempts, Swiss Sorelle Trade Sàrl, www.houseart.ch, is entitled to withdraw from the contract. Any payments already made will be refunded immediately.
6. Payment Conditions
6.1 Payment may be made by advance payment, invoice, credit card, PayPal, or TWINT.
6.2 When choosing advance payment, Swiss Sorelle Trade Sàrl, www.houseart.ch, provides its bank details in the order confirmation. The invoiced amount must be transferred to the seller’s account within 14 days.
6.3 For credit card payments, the customer’s account is charged upon confirmation of purchase, unless otherwise agreed.
6.4 Set-off against claims of the customer that are not recognized or legally established is excluded.
6.5 The customer may exercise a right of retention only if the claims arise from the same contract.
7. Late Payment / Reminder / Debt Collection
7.1 The invoice must be paid within 10 days of delivery of the goods. If payment is not made within this period, the customer is in default (late payment).
8. Retention of Title
Swiss Sorelle Trade Sàrl, www.houseart.ch, retains ownership of the goods until full payment has been made. Prior to the transfer of ownership, pledging, assignment by way of security, processing, or modification of the goods is not permitted without the seller’s consent.
9. Warranty
9.1 Swiss Sorelle Trade Sàrl, www.houseart.ch, provides a warranty for the repair of defects. The seller may choose either to repair the delivered goods or to replace the defective goods with defect-free goods.
9.2 If repair fails, the customer is entitled to withdraw from the contract. This does not apply to minor defects. Any right to a price reduction is excluded.
10. Liability
Swiss Sorelle Trade Sàrl, www.houseart.ch, excludes all liability for breaches of contract due to slight negligence. Liability for acts of auxiliary persons and subcontractors is also excluded.
11. Personal Data Protection
Swiss Sorelle Trade Sàrl, www.houseart.ch, undertakes to process and use the customer’s personal data in accordance with applicable laws. Further information is available in the “Data Protection” policy published on the website www.houseart.ch.
12. Final Provisions
Should any provision of these General Terms and Conditions conflict with applicable law, the validity of the contract and the remaining provisions shall remain unaffected. The applicable statutory provisions shall apply in place of the invalid provision.
